Vehicle Registration in Maharashtra RTO

Registration of New Vehicle

The Government does not allow the use of an unregistered vehicle in the state. Despite the vehicle being registered in another Indian state, it still needs to be registered in Maharashtra before it can be driven on the road. The vehicle can be directly registered via the dealer by including the registration details on his or her trade certificate. Then the vehicle can be brought for inspection by the Motor Vehicle inspector. After all the processes are completed, a new registration number can be assigned to the vehicle. The documents to be submitted to the RTO are:

• Form 20 is the form through which the RTO registration of the new vehicle is done.
• Form 21 along with the sales certificate. These have to be provided by the dealer who sold the vehicle to the owner.
• Form 22A should include the declaration of the manufacturer's compliance with pollution and safety standards and roadworthiness.
• If life-time tax is applicable on purchase of the vehicle, the invoice of the purchase is required.
• For all vehicles except two-wheelers, two copies of the PAN number or Form 60 is to be provided.
• A certificate of insurance of the vehicle.
• A document that acts as proof of address.
• If the vehicle is imported, bill of entry is to be provided.
• If the vehicle to be registered is a carriage, manufacturer's certificate is also required.
• If the vehicle is a trailer, the Transport Commissioner's approval of the design of the vehicle is required.
• If a person owns a tractor or a trailer, he or she can avail tax exemption by providing the tehsildar certificate.
• If the vehicle has been bought from outside the state, proof of tax payment is required.

Transfer Ownership or Re‑registration (Inter‑State/New Number)

If the vehicle has been brought to Maharashtra from another state or registration of a new mark is needed, then the application for the same can be made via Form 20 and Form 26. Other documents that need to submitted in addition to the ones mentioned earlier are:

• If the owner wants to change the address, he or she has to fill out Form 33.
• If the owner of the vehicle wants to transfer the ownership, Form 29 and Form 30 have to be filled with the required details.
• Form AT and FT.
• Form 28 which includes the No Objection Certificate from the financier. It should also include the imprint of the chassis fixed on the form by the registering authority.
• If the vehicle is intended for commercial purposes, Form TCA and Form TCR are also required.
• If the vehicle has been transferred from another state to Maharashtra within 30 months of its first registration, a proof of the entry tax payment is to be provided by the owner.
• The owner of the vehicle has to also provide an affidavit which states that the vehicle is free from any past accidental experiences, crime or theft.
• The owner of the vehicle has to also produce all the documents related to the vehicle as well.

Certificate of No Objection

The documents to be submitted for the owner to receive the No Objection Certificate are:

• Form 28.
• Form 29, in case the owner is selling the vehicle.
• A document stating the consent of the financier.
• Certificate of No Objection from the local police department.
• Other documents such as:

1. Certificate of Registration
2. Certificate of Insurance
3. Tax Certificate
4. Graduation Certificate

A person can also apply for the cancellation of the Certificate of No Objection. The steps to do that are:

• The recipient of the Certificate of No Objection has to return the original copy to the RTO.
• The owner of the vehicle has to provide an affidavit to the registering authority which states that the vehicle has not been misused.

Transfer of Vehicle Ownership

Some of the rules specified by the government regarding the transfer of vehicle ownership are:

• If the vehicle is being sold in the same area, the time limit for the intimation of the sale is 14 days.
• If the vehicle is being sold in an area that comes under another RTO's jurisdiction, the time limit for the intimation of the sale is 30 days.

For the transfer of vehicle ownership from one person to the other, the following documents are required:

• Form 29: This form contains the details of the seller.
• Form 30: This form contains the details of the buyer.
• Form 28: This form contains is to be submitted if the buyer's residential location falls under jurisdiction of a different RTO.
• The other documents to be submitted along with the ones mentioned above are graduation certificate, certificate of insurance, certificate of registration and tax statements.

Vehicle Insurance in Maharashtra

Every vehicle that is registered under the Motor Vehicles Act of 1998 has to be insured. Any person who has suffered from road accident that has been caused by a vehicle can avail compensation under the provision of Section 140. The types of motor vehicular insurance are:

• Third-party policy insurance: This is the cheapest insurance plan that there is. It will only cover any damages caused to the third person during the accident and not damage to own vehicles. These policies are usually one-year renewable plans.
• The Comprehensive policy insurance:Unlike the third party insurance, comprehensive policy insurance covers both third-party and own damages, including injuries to the person and damage to the vehicles involved.

If for any reason, the vehicle owner wants a re-issue of the insurance certificate, a duplicate may be availed by visiting the office of the concerned company. Vehicular insurance needs to be transferred to the new owner if there is a change of vehicle ownership. To make a claim for insurance in case of a road accident, the following documents need to be submitted at the office of the concerned company:

• Driving licence of the vehicle owner.
• Certificate of insurance of the vehicle.
• Certificate of registration of the vehicle.
• The FIR of the incident.
• The permit of the vehicle.
• Certificate of fitness of the vehicle.
• The estimation report of the incident by the surveyor of the organisation which will provide the insurance.

Fees

1. The fees for registration of a new vehicle in Maharashtra is as follows:

1. The fee for issue of the duplicate registration certificate is half the amount required for registration of the vehicle.
2. The fee for renewal registration certificate is:

1. The charges levied for the issue of new registration mark for vehicles coming from another state are as follows:

1. For the change of address in registration certificate,the charges levied are:

1. For the following three situations, the charges levied by the Maharashtra transport department are the same:

• Transfer of ownership of the vehicle.
• Transfer of ownership after the death of the owner of the vehicle.
• Transfer of ownership of a vehicle purchased in public auction.

1. If the vehicle is being transferred in the name of the financier, there are no charges levied by the transport department.
2. The cost of endorsement of a hire/purchase agreement are:

1. There is no cost for termination of a hire/purchase agreement.
2. The Certificate of No Objection can be obtained for free.
3. The cost of renewal of certificate of fitness is as follows:

1. A duplicate certificate of fitness costs Rs.100.
2. The charges levied by the Maharashtra transport department for alteration in the vehicle is as follows:

1. To lodge an appeal under Rule 46, Rs.1000 has to be paid.
2. The cost of conduction of a test to grant the F.C. to the vehicle is as follows:

1. The fees for grant and renewal of letter authority is Rs.15000.
2. The fees for issue of duplicate grant and renewal of letter authority is Rs.7500.
3. The fees for lodging an appeal under rule 70 is Rs.3000.
