Drink and Drive Fines in India 2025

According to Section 185 of the Motor Vehicle Act 2019, drinking and driving is illegal in India and is a criminal offense. The drink and drive fine that is levied if you are caught can range from up to Rs.10,000 to Rs.15,000 and/or jail time.

The fines that must be paid in case of a drink and drive offense are mentioned below:

  1. First Offense: Fine up to Rs.10,000 and/or 6 months imprisonment. Earlier, the fine was Rs.2,000.
  2. Second Offense: The fine is Rs.15,000 and/or 2 years imprisonment. Driving license penalties may be levied on repeat offenders as well. Earlier, the fine was Rs.3,000.

The above-mentioned fines are for all vehicles including commercial vehicles, four-wheelers, three-wheelers, and two-wheelers.

Process to Pay the Fines

In case of a drink and drive offense, a challan will be issued and the vehicle will be detained. The vehicle will be given back to you only once the fine is paid. The different ways that the drink and drive fine can be paid are mentioned below:

Offline

You will need to visit the traffic police station and provide the challan. The fine amount must be paid and will depend on the violation. Once the fine is paid a receipt will be provided.

Online

  1. Visit the official website of the state transport department.
  2. Select ‘Traffic Violation Payment’ or ‘Payment of e-Challan’.
  1. Enter the challan number or vehicle registration number.
  2. Enter the captcha and proceed to the next page.
  3. The payment can be made via UPI, e-wallets, credit cards, or debit cards.
  4. A receipt will be sent to the registered mobile number. The receipt must be shown at the traffic police station so that the vehicle can be released.

It is important that you carry the driver’s license when you visit the police station. Along with the driving license, you must carry a copy of the vehicle’s insurance and registration certificate as well.
